Welcome to AsylumDesk. By accessing or using our platform, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the platform.
1. Service Description
AsylumDesk is an AI-powered research and drafting tool designed for licensed immigration attorneys handling removal defense cases. The platform provides document analysis, country conditions research, I-589 pretermission checking, and brief drafting capabilities.
2. Account Responsibilities
You are responsible for:
- Maintaining the confidentiality of your account credentials
- Enabling two-factor authentication for enhanced security
- All activities that occur under your account
- Ensuring you have proper authorization to upload client documents
- Complying with all applicable attorney-client privilege obligations
3. AI-Generated Content Disclaimer
AsylumDesk does not provide legal advice. The platform is a tool to assist attorneys in their professional practice. The attorney of record bears full responsibility for all filings, arguments, and representations made to courts and government agencies.
4. Billing and Payments
AsylumDesk operates on a pay-per-action billing model. New accounts receive a 14-day trial period. After the trial:
- A valid payment method is required to use billable features
- Charges are made per action (document analysis, research queries, brief drafting)
- Current pricing is displayed on the Pricing page
- All payments are processed securely through Stripe
- Refund requests are handled on a case-by-case basis
5. Acceptable Use
You agree not to:
- Use the platform for any unlawful purpose
- Upload malicious files or content
- Attempt to access other users' accounts or data
- Circumvent security measures or rate limits
- Use the platform to generate fraudulent legal documents
- Share account credentials with unauthorized individuals
6. Intellectual Property
You retain ownership of all documents and case materials you upload. AI-generated content (analysis results, drafted briefs) is licensed to you for use in your legal practice. The AsylumDesk platform, including its design, code, and AI prompts, remains our intellectual property.
7. Limitation of Liability
To the maximum extent permitted by law, AsylumDesk shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform. Our total liability shall not exceed the amount you paid for the service in the 12 months preceding any claim.
8. Termination
You may close your account at any time. We reserve the right to suspend or terminate accounts that violate these terms. Upon termination, your data will be handled according to our Privacy Policy.
9. Changes to These Terms
We may modify these Terms of Service at any time. Material changes will be communicated via email. Continued use of the platform after changes constitutes acceptance of the updated terms.
